All sales from Metrowest Computers and Services, on stocked items to purchaser are subject to following terms and conditions. DAMAGED MERCHANDISE Damaged shipments from handling must be claimed with the freight carrier. If any cartons are missing or damaged, be sure to note this on the freight bill. If you notice concealed damage after the driver has left, keep all the packing and call the freight carrier to return and inspect the damage and file a claim. We cannot be responsible for damage caused by the freight carrier. MANUFACTURER DEFECTS If a product appears to have a manufactures defect do not return Items to us without first calling to receive instructions. If an item is to be returned to us due to manufactures defect, you must first receive a Return Authorization Number. No packages will be accepted without a Return Authorization Number written clearly on the box. OTHER TERMS AND CONDITIONS Metrowest Computers and Services warrants to the original purchaser that the purchased products will meet applicable specifications (as set forth in the product description in METROWEST COMPUTERS and Services technical manuals), same to be free from defects in materials under normal use and service. Metrowest Computers and Services has a 7 day money back policy. Some components may carry an additional warranty as a result of the warranty provided by the manufacturer, and these warranties must be processed by the component manufacturer. Special order and non-stocked items do not have a money back guarantee. Metrowest Computers and Services custom-built systems carry a 7 day money back policy and a two year parts and labor warranty with the Operating System installed. After 7 days, Metrowest Computers and Services will repair or replace components only, no credits will be issued. The manufacturer’s warranty, which may be different than Metrowest Computers and Services warranty, applies to any special order non-stocked items included in or with the system. A new warranty period shall not be established for any replacement products, and such replaced products shall be warranted only for the remainder of the original warranty period. The warranties contained herein do not cover any damage due to accident, misuse, abuse, negligence, or acts of god. All warranty work is performed at METROWEST COMPUTERS and Services, FRAMINGHAM, MA, location and requires an Return Authorization Number (see Product Returns below). IN NO EVENT WILL METROWEST COMPUTERS AND SERVICES BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES EVEN IF METROWEST COMPUTERS AND SERVICES HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE WARRANTIES CONTAINED HEREIN ARE IN LIEU OF ALL OTHER WARRANTIES EXPRESSED, IMPLIED OR STATUTORY, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. EXCEPT FOR DAMAGE DUE TO METROWEST COMPUTERS AND SERVICES NEGLIGENCE OR WILLFUL MISCONDUCT, THE LIMITATION OF Dragon Systems AND SERVICES TOTAL LIABILITY HEREUNDER SHALL NOT EXCEED THE TOTAL AMOUNT PAID TO METROWEST COMPUTERS AND SERVICES UNDER THIS INVOICE. This Limited Warranty gives specific legal rights. One may also have other rights, which vary from state to state. Some states do not allow for the exclusion of consequential damages or the limitation on the duration of implied warranties; accordingly, the exclusion and limitation contained herein may not be applicable in some circumstances. ANY WARRANTY FOR SOFTWARE INCLUDED ON OR RELATING TO THE PRODUCTS PURCHASE HEREUNDER HAS BEEN SUPPLIED BY THE MANUFACTURER. Dragon Systems AND SERVICES MAKES NO REPRESENTATION OR WARRANTY, EITHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTY OF MERCHANTABILITY OR THE WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT THERETO AND SHALL HAVE NO LIABILITY IN CONNECTION THEREWITH. Products sold by METROWEST COMPUTERS AND SERVICES are not designed for use in life support equipment where malfunction of such product can reasonably be expected to result in personal injury. Purchasers using or selling such products for use in life support equipment do so at their own risk and agree to fully indemnify METROWEST COMPUTERS AND SERVICES and the manufacturer of such products for any damages resulting from such use or sale. If technical advice is offered or given in connection with the use of any products, it will be as an accommodation to purchaser and without charge, and METROWEST COMPUTERS AND SERVICES shall have no responsibilities or liabilities whatsoever for the content or use of such advice. Technical support on special order and/or non-stocked items is the responsibility of the manufacturer and is not supplied by METROWEST COMPUTERS AND SERVICES technical staff. PRODUCT RETURNS A Return Authorization Number (RAN) number must be issued before any product may be returned to METROWEST COMPUTERS and Services. To obtain an RAN number send an e-mail to our technical support department, with the original invoice number and description of the problem. A RAN number will be issued where appropriate. The number must be displayed clearly on the outside of the shipping package. RAN numbers are good for 30 days from the date of issue and RAN products must be received freight pre-paid, METROWEST COMPUTERS and Services shall not accept COD RAN returns. Products being returned for credit must include complete packaging, manuals, cables, etc. If any of these items are missing or damaged, credit can not be issued. Special order and non-stocked items must be returned to the manufacturer for warranty and/or repair issues. After a return is authorized by our return department: 1. Return the item to the address given to you by our return department. 2. Write the Return Authorization Number on the box. 3. Keep your shipping records for proof of shipment in the event of loss of returned merchandise. Returns shipped via U.S. Postal Service (U.S.P.S.) or with a value of over $100.00 should be insured. We are not liable for return merchandise that does not reach our return department. RETURNS ON COMPUTERS, SYSTEMS AND SOFTWARE ONLY Computer Systems, Software and equipment are returnable for up to 7 days from the date of purchase for a refund, excluding shipping charges. A Return Authorization Number must be obtained before returning these items by sending an email to RMA@METROWESTCOMPUTER.COM. All returns must have the RAN marked clearly on the outside of the box and the copy of original receipt must be placed within the package for our records. Damaged items will not be accepted for return. Opened Software also will not be accepted for return due to copyright laws. When calling or sending email to our return department, please let our representative know the exact reason for the return. All refunds for returned equipment will be given excluding shipping charges within 7 to 14 days of your return in the form of payment given when your order was placed, ie: check, money order, credit card. RESTOCKING FEES A 15% restocking fee may apply to all returns, shipping and handling charges are non-refundable. GOVERNING LAW AND FORUM Any dispute regarding the interpretation or validity hereof shall be governed by the laws of the State of Massachusetts without regard to conflicts of law. METROWEST COMPUTERS and Services, and purchaser hereby agree that any dispute relating to the terms and conditions of sale furnished hereunder shall be subject to the jurisdiction of the courts of Massachusetts.
